According to the Road Rules 2014 (NSW), Clause 266, the driver of a motor vehicle must ensure passengers under 16 years wear a seatbelt or restraint except when the vehicle is a bus.
This means that in NSW buses carrying more than 12 passengers, the driver is not legally required to ensure children use child restraints, even if they are under 16 years of age. However, where seatbelts are fitted to the bus, passengers are strongly encouraged to wear them for safety.
Baby Seat Laws NSW and Child Restraints on Charter Buses
While the law does not mandate baby seats on buses, child safety remains a priority. Many families travelling on charter buses or airport transfer coaches choose to bring their own child restraint or booster seat.
Key safety recommendations include:
- Children should sit in the rear seats of the bus where possible.
- If the vehicle is fitted with seatbelts, they should always be worn.
- Parents should never share a seatbelt with a child.
- Children must not sit on an adult’s lap while sharing a seatbelt, as this can cause serious injury in a collision.
- Infants should not be carried in arms while the vehicle is moving.

Any bus providing commercial passenger transport in NSW must be accredited under the Passenger Transport Act 2014.

Type 1 – Regular Route Services
Government and contracted route buses operating scheduled services.
Type 2 – Long Distance, Tourist and Charter Services
Includes private coach hire, airport transfers, tour buses and charter buses.
Accredited charter buses operate under similar regulatory conditions to public route buses regarding seatbelt and restraint requirements.
However, unlike route buses, prams cannot be used as a restraint device on charter buses. For safety reasons they must be folded, secured and stowed to prevent movement during braking or an emergency stop.
Minibuses, Licensing and Child Restraint Anchor Points
Another important distinction under NSW transport regulations relates to vehicle capacity and driver licensing.
- Vehicles with up to 12 seats including the driver can be driven on a standard C Class licence.
- Vehicles with 13 seats or more require a Light Rigid (LR) licence.
If a larger vehicle is modified to reduce seating capacity to 12 seats, child restraint anchor points may legally need to be installed along with engineering certification.
